These Terms & Conditions ("Terms") apply to your use of www.elastudiodubai.com (the "Website"), the ela.studio booking platform or ela.studio mobile application, and all classes, private sessions, events, facilities and services provided by elamovement ladies physical fitness club l.l.c s.o.c, trading as ela.studio ("ela.studio", "we", "us" or "our").

Our studio is located at Office 220, Binghatti Azure, Jumeirah Village Circle, Dubai, United Arab Emirates.

By creating an account, purchasing a class or membership, making a booking, or attending any class, you confirm that you have read, understood and agreed to these Terms.

1. STUDIO ACCESS

ela.studio is a women-only boutique Reformer Pilates studio. Participation is subject to availability, suitability for the selected class and compliance with these Terms.

Clients under 16 may attend only with prior approval from ela.studio and written consent from a parent or legal guardian.

We reserve the right to refuse entry or participation where reasonably necessary for health, safety, privacy or appropriate studio conduct.

2. ARRIVAL AND LATE ENTRY

Please arrive at least 5 minutes before your class.

First-time clients must arrive 10 minutes early discuss relevant health information and receive an introduction to the reformer.

For health and safety reasons, the studio door may be locked once a class begins, maximum 5 min after class start. Late entry will not be permitted because it interrupts the class and prevents the instructor from providing the required safety introduction.

If you are refused entry because you arrived late, the booking will be treated as a late cancellation and the class credit will not be returned.

3. BOOKINGS

All classes must be booked through the official ela.studio booking platform, mobile application or another

approved booking partner.

Bookings are personal and may not be transferred, shared or resold without written approval from ela.studio.

You are responsible for ensuring that the class selected is suitable for your experience and physical condition. If you are new to Reformer Pilates, we recommend beginning with FORM.

4. CANCELLATIONS AND NO-SHOWS

Group-class bookings must be cancelled or rescheduled at least 12 hours before the scheduled start time.

If you cancel or reschedule within 12 hours of the class, the class credit will be deducted from your package or membership. Failure to attend a booked class will be treated as a no-show, and the class credit will be deducted.

Cancellations must be completed through the booking platform. Messages sent by Instagram, WhatsApp or email do not constitute a valid cancellation unless expressly confirmed by ela.studio management.

Private sessions and private events may have a separate cancellation period stated at the time of booking.

5. WAITLIST

If a class is full, you may join the waitlist through the booking platform.

When a space becomes available, you will be notified using the contact details connected to your account. By joining the waitlist, you accept responsibility for monitoring your booking status.

If you can no longer attend, you must remove yourself from the waitlist. Once added to the class, the usual cancellation policy applies unless otherwise stated in the booking platform.

If you remain on the waitlist and are not added to the class, no class credit will be deducted.

6. CLASS PACKAGES, CREDITS AND MEMBERSHIPS

Each package or membership is subject to the price, validity period, booking entitlement and additional conditions displayed at the time of purchase.

Unless expressly stated otherwise:

- Credits are personal, non-transferable and may not be shared or resold.

- Credits must be used before their stated expiry date.

- Unused credits expire automatically and are not carried forward.

- Package validity begins on the date specified at purchase.

- Promotional and introductory offers are limited to one per eligible client.

- Membership benefits cannot be exchanged for cash.

-Membership and package policies are always stated accordingly and separately for each specific kind and type.

Requests for a medical extension or suspension must be supported by appropriate medical documentation and remain subject to review and written approval.

If a membership renews automatically, its renewal schedule, minimum commitment and cancellation procedure will be clearly disclosed before purchase. Cancelling a class booking does not cancel a recurring membership.

7. PAYMENTS AND PRICES

All prices are stated in UAE dirhams and does not include VAT.

Payment must be completed before attending a class. We may amend our prices, packages or membership options from time to time, but a price change will not retrospectively alter a completed purchase.

You are responsible for providing complete and accurate payment and account information.

8. REFUNDS

Purchases are generally non-refundable and non-transferable once completed, except where a refund is required under applicable UAE law or expressly approved by ela.studio.

A change of mind, failure to attend, late arrival, unused credits or expiry of a package does not normally qualify for a refund.

If ela.studio cancels a class, the affected credit will be returned to your account. Where returning the credit is not reasonably possible, an appropriate alternative will be offered.

Nothing in these Terms limits any consumer right that cannot legally be excluded.

9. SCHEDULE AND INSTRUCTOR CHANGES

Class schedules, formats and instructors may change.

ela.studio may substitute an instructor, modify a class, combine sessions or cancel a class where reasonably necessary. An instructor substitution does not entitle a client to a refund or returned credit.

Where ela.studio cancels the entire class, the affected credit will be returned to the client's account.

10. HEALTH DECLARATION

Physical exercise carries inherent risks. By participating, you confirm that you are physically able to take part safely and that you accept the normal risks associated with exercise and Reformer Pilates.

Before class, you must inform your instructor of any relevant:

- Injury, pain or physical limitation

- Illness or medical condition

- Pregnancy or recent pregnancy

- Recent surgery or medical procedure

- Medication that may affect exercise

- Dizziness, fainting, chest pain or breathing difficulty

You are responsible for seeking medical advice before participating if you are pregnant, recovering from injury or surgery, managing a medical condition, or uncertain whether exercise is appropriate for you.

The information provided by instructors is not medical advice and should not replace advice from a qualified healthcare professional.

You must follow the instructor's directions, use the equipment only as demonstrated and stop immediately if you experience pain, dizziness, faintness, shortness of breath or other unusual symptoms.

11. ASSUMPTION OF RISK AND LIABILITY

By attending a class or using studio equipment, you acknowledge that physical exercise involves a risk of injury.

To the fullest extent permitted by applicable law, ela.studio is not responsible for injury, loss or damage resulting from:

- Risks normally associated with physical exercise

- Your failure to disclose relevant health information

- Your failure to follow instructor guidance

- Improper or unauthorised use of equipment

- Participation against medical advice

- The actions of another client or an unrelated third party

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability arising from fraud, wilful misconduct or a failure to exercise legally required care.

In an emergency, you authorise ela.studio to provide reasonable first-aid assistance and contact emergency services when considered necessary. Any resulting third-party medical costs remain your responsibility.

12. STUDIO RULES

For everybody's safety, comfort and privacy:

- Grip socks are required during Reformer classes.

- Equipment must be used only as directed by the instructor.

- Mobile phones must be placed on silent; calls must not be taken during class.

- Photography or filming must not identify another client without her express consent.

- Clients must maintain appropriate hygiene and respectful behaviour.

- Abusive, discriminatory, threatening or disruptive conduct will not be tolerated.

- Food is not permitted unless it is arranged as a part of event organised by ela.studio.

- Smoking and vaping are prohibited throughout the studio.

- Animals are not permitted, except where required by applicable law.

ela.studio may ask a client to leave or suspend future bookings where these rules are breached. Credits or fees may be forfeited where access is suspended because of serious or repeated misconduct.

13. PERSONAL BELONGINGS

Personal belongings remain your responsibility while you are at the studio.

ela.studio is not responsible for lost, stolen or damaged property except where the loss or damage results from circumstances for which liability cannot legally be excluded.

Please do not bring valuable items into the studio. Any lost property may be retained for a limited period and

then donated or disposed of.

14. ACCOUNTS AND PASSWORDS

You are responsible for maintaining the confidentiality of your login details and for all activity conducted through your account.

You must provide accurate information and notify us promptly if you suspect unauthorised access.

We may suspend an account where we reasonably suspect fraud, misuse, credit sharing or a breach of these Terms.

15. WEBSITE AND INTELLECTUAL PROPERTY

The Website and its contents - including the ela.studio name, branding, logos, photography, videos, graphics, written material, class concepts and designs - are owned by or licensed to elamovement ladies physical fitness club l.l.c s.o.c and are protected by applicable intellectual-property laws.

Content may be viewed for personal, non-commercial use only. It may not be copied, reproduced, distributed, sold, modified or commercially used without prior written permission.

You must not attempt to interfere with the Website, booking platform, security features or other clients'

accounts.

16. COMMUNICATIONS

By creating an account or making a booking, you consent to receiving operational communications relating to bookings, payments, schedule changes, waitlists and your account.

Marketing communications will be sent in accordance with your communication preferences and applicable law.

You may unsubscribe from marketing messages, but you may still receive essential service communications.

17. PERSONAL DATA AND PRIVACY

We process personal data in accordance with our Privacy Policy and applicable UAE data-protection requirements.

Information may be shared with service providers where reasonably necessary to process payments, manage bookings, operate our systems or deliver services.

Health information disclosed to instructors will be handled with appropriate care and used only where relevant

to your participation, safety or legal obligations.

Please refer to the ela.studio Privacy Policy for further information about how personal data is collected, used, stored and protected.

18. SUSPENSION AND TERMINATION

You may stop using ela.studio services at any time, subject to the conditions of any active membership or contractual commitment.

We may restrict or terminate access to the studio, Website or booking account where you:

- Breach these Terms or studio rules

- Misuse packages, credits or promotions

- Behave in an unsafe, abusive or disruptive manner

- Fail to make a required payment

- Provide materially false or misleading information

Termination resulting from your breach does not automatically entitle you to a refund.

19. EVENTS OUTSIDE OUR CONTROL

ela.studio is not responsible for delay, interruption or cancellation caused by circumstances reasonably outside its control, including building restrictions, utility failure, government action, severe weather, public-health measures or other force-majeure events.

Where reasonably possible, we will return affected credits, extend their validity or offer an appropriate alternative.

20. THIRD-PARTY LINKS

The Website may contain links to websites or services operated by third parties.

ela.studio does not control and is not responsible for third-party content, privacy practices, availability or services. Accessing a third-party service is at your own discretion and may be subject to separate terms.

21. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our services, policies or legal obligations.

The updated version will be published on the Website with a revised effective date. Material changes affecting an active membership will be communicated where reasonably required.

Continued use of our services after updated Terms take effect constitutes acceptance of those Terms, subject to applicable law.

22. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the United Arab Emirates and the applicable laws and regulations of the Emirate of Dubai.

Any dispute arising from these Terms or the use of ela.studio services will be subject to the jurisdiction of the competent courts of Dubai, unless applicable law requires otherwise.

23. GENERAL

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in

effect.

A failure or delay by ela.studio in enforcing any provision does not waive our right to enforce it later.

These Terms, together with the Privacy Policy and the specific conditions shown for a package or membership at purchase, constitute the agreement between you and ela.studio concerning the relevant services.
